Like our case filed in the United States, we are seeking to finally end Apple’s monopolistic app distribution policies, which stifle competition and threaten the ability of developers to innovate and create new kinds of games, apps and businesses. Today, we filed a lawsuit against Apple in Australia. Its conduct is an abuse of a dominant position and in breach of EU competition law. Following complaints by other app developers, the European Commission is already investigating Apple’s abusive conduct, and Epic is joining these efforts. The complaint alleges that Apple uses its control of the iOS ecosystem to benefit itself while blocking competitors. As is the case in the United States and Australia, we are fighting to stop Apple's anticompetitive practices that are harming app developers and consumers. Today, we announced that we have filed an antitrust complaint against Apple in the European Union.

In fact, in Australia, almost half of the approximately 20 million smartphones across the country run on Google’s Android OS, and 90% of apps on an Android mobile are typically obtained via the Google Play Store. As a result, Google Play has a vast majority of Android store market share in territories where it’s available.

Google advertises Android as an open platform, but the reality paints a different picture downloading software directly is unnecessarily difficult and scary, and pre-installed app stores are rarely permitted. This follows a case we filed on similar grounds against Apple in Australia in November 2020. Today, we have taken the next step in our pursuit for fairer digital platforms globally, filing a lawsuit against Google in Australia’s Federal Court. Epic is pursuing legal action against Google over the “Restrictive Terms” of the Google Play Store Developer Distribution Agreement (DDA) that led to the removal of Fortnite from the Google Play Store. This arrives on the heels of a recent ruling from the Competition Appeal Tribunal on Epic’s case against Google. The complaint alleges that Apple’s anticompetitive behavior and prohibitively restrictive rules governing the distribution of apps and payment processing constitute a clear violation of UK competition law. Today we announced that we have filed a complaint against Apple in support of the United Kingdom Competition and Markets Authority’s (CMA) investigation into the company’s monopolistic App Store policies.

Here are the papers for Apple ( August 13, August 17, August 23, and September 4, 2020) and Google ( August 13, 2020). Here is Epic’s pre-trial Findings of Facts and Conclusions of Law document and here is an updated version of Epic’s Findings of Facts and Conclusions of Law document that was filed with the Court after the trial concluded. This is why we fight.Įpic has taken legal action to end Apple and Google’s anti-competitive restrictions on mobile device marketplaces. We are committed to securing lasting freedoms for all. These policies, together with Apple’s chilling enforcement strategy, directly impede innovation and invention of entirely new kinds of apps, games, and businesses.Įpic is one of the many game developers who has long worked to advance better and fairer platform practices, such as cross-platform gameplay, communication, accounts, and items in Fortnite on 7 platforms (though now only 6).

Apple’s policies would have even blocked the World Wide Web if it had been invented after the iPhone, because Apple policies disallow running code not reviewed by Apple, accepting payments directly from customers, and accessing content not reviewed by Apple - all fundamental features of the web. Apple and Google’s policies take these freedoms away.Īpple’s policies are so restrictive that they block gaming services like Microsoft xCloud, NVIDIA GeForce NOW, and Google Stadia from existing on iOS. Software makers have the right to freely express their ideas and to compete in a fair marketplace.

You, as a mobile device owner, have the right to install apps from sources of your choosing. As a matter of principle, we refused to do so. Their proposal was an invitation for Epic to collude with Apple to maintain its monopoly over in-app payments on iOS, suppressing free market competition and inflating prices.

Further, Apple threatened to prevent Epic from creating software for all Apple devices - not just on Fortnite but all of our games, and Unreal Engine too.Īpple demanded that Epic revert Fortnite to exclusively use Apple payments. Both Apple and Google retaliated by blocking Fortnite updates. Epic gave Fortnite players on iOS and Google Play a choice between Apple/Google payment and Epic direct payment, passing on savings to direct purchasers.
